1. Acceptance of Terms

By downloading, installing, accessing, or using the EzyTrip application ("App"), website ("Site"), or any services provided by EzyTrip LLC (collectively, "Services"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference.

1.1 Eligibility

• You must be at least 18 years of age to create an account and use the Services.
• By using the Services, you represent and warrant that you meet this age requirement.
• EzyTrip LLC reserves the right to verify age and identity at any time.

1.2 Account Registration

• You may use certain features of the App as a guest without an account.
• To access the EZ Rewards loyalty program, you must register for an account.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify EzyTrip LLC immediately of any unauthorized use of your account.

2. Use of Services

2.1 Permitted Use

EzyTrip LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for personal, non-commercial purposes in accordance with these Terms.

2.2 Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any portion of the Services or related systems.
• Use automated tools, bots, scrapers, or similar technologies to access the Services.
• Reverse engineer, decompile, or disassemble any part of the App or Services.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Transmit any harmful, offensive, or disruptive content through the Services.
• Attempt to manipulate or fraudulently earn EZ Rewards loyalty points.
• Share, sell, or transfer your account or loyalty points to another person.

3. Fuel Price Information

3.1 Accuracy Disclaimer

EzyTrip LLC provides fuel price information as a convenience to users. While we make reasonable efforts to keep pricing current and accurate:

• Fuel prices displayed in the App are for informational purposes only and are subject to change without notice.
• Actual prices at the pump may differ from those shown in the App due to real-time market fluctuations, local taxes, promotions, or technical delays.
• EzyTrip LLC does not guarantee the accuracy, completeness, or timeliness of any fuel price information.
• Prices may vary by payment method (cash vs. credit card) or other factors at the point of sale.

3.2 No Price Guarantee

The display of a fuel price in the App does not constitute a binding offer or price guarantee. EzyTrip LLC is not liable for any difference between the price displayed in the App and the price charged at the pump.

4. EZ Rewards Loyalty Program

4.1 Program Overview

The EZ Rewards program allows registered users to earn points on qualifying fuel purchases and redeem those points for rewards at participating EzyTrip locations.

4.2 Earning Points

• Points are earned on qualifying fuel purchases at participating EzyTrip locations.
• You must be logged into your EzyTrip account at the time of purchase for points to be credited.
• EzyTrip LLC reserves the right to modify the point-earning rate at any time with reasonable notice.
• Points may not be earned on certain promotional items or third-party products unless specifically stated.
• Bonus point promotions (e.g., Double Points Fridays) are subject to change or cancellation.

4.3 Redeeming Points

• Points may be redeemed for fuel discounts, food and beverage items, car wash services, or other rewards as specified in the App.
• Redemption is subject to availability and participating location restrictions.
• Partial redemption is permitted where the redemption value exceeds the purchase amount, at EzyTrip LLC's discretion.
• Points have no cash value and cannot be exchanged for cash, check, or other monetary equivalents.

4.4 Points Expiration

• EZ Rewards points expire after 12 months of account inactivity (no qualifying purchase or redemption).
• EzyTrip LLC will provide at least 30 days' notice via email before expiring points due to inactivity.
• Points earned through fraudulent activity will be forfeited without notice.

4.5 Tier Structure

• Bronze Tier: 0 - 1,499 points accumulated in a rolling 12-month period.
• Silver Tier: 1,500 - 3,999 points accumulated in a rolling 12-month period.
• Gold Tier: 4,000+ points accumulated in a rolling 12-month period.
• Tier benefits are subject to change with 30 days' advance notice to members.

4.6 Program Modification or Termination

• EzyTrip LLC reserves the right to modify, suspend, or terminate the EZ Rewards program at any time.
• In the event of program termination, EzyTrip LLC will provide at least 60 days' notice and allow redemption of accumulated points during that period.
• EzyTrip LLC is not liable for any lost points resulting from account closure due to violation of these Terms.

5. Intellectual Property

All content, features, and functionality of the App and Site, including but not limited to text, graphics, logos, images, and software, are the exclusive property of EzyTrip LLC and are protected by applicable intellectual property laws. The EzyTrip name, logo, and all related marks are trademarks of EzyTrip LLC.

• You may not use, copy, reproduce, or distribute any content from the Services without prior written consent from EzyTrip LLC.
• You are granted a limited license to view and use the App for personal, non-commercial purposes only.

6. Location Services

The App may request access to your device's location to provide location-based features such as store locator and fuel price information for nearby locations.

• Location access is optional. You may use limited features of the App without enabling location services.
• Location data is used only to improve your in-app experience and is handled in accordance with our Privacy Policy.
• EzyTrip LLC does not sell location data to third parties for advertising purposes.

7. Third-Party Services

The App may contain links to or integrate with third-party services (e.g., mapping services, payment processors). These third-party services are subject to their own terms and privacy policies.

• EzyTrip LLC does not endorse, control, or assume responsibility for any third-party content or services.
• Your use of third-party services is at your own risk.

8. Disclaimers & Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EZYTRIP LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EZYTRIP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF EZYTRIP LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EzyTrip LLC's total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to EzyTrip LLC (if any) in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless EzyTrip LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Services.
• Your violation of these Terms and Conditions.
• Your violation of any third-party rights, including intellectual property rights.
• Any fraudulent activity related to your account or EZ Rewards participation.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Kentucky. You waive any right to a jury trial or to participate in a class action lawsuit.

10.3 Small Claims

Notwithstanding the above, either party may bring a claim in small claims court for disputes within the court's jurisdictional limits.

11. Modifications to Terms

EzyTrip LLC reserves the right to modify these Terms at any time. Changes will be effective upon posting to the App or Site. We will provide notice of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

12. Termination

EzyTrip LLC may suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Services immediately ceases.
• Accumulated EZ Rewards points in violation of these Terms will be forfeited.
• Sections relating to intellectual property, disclaimers, indemnification, and governing law shall survive termination.

13. Apple App Store & Google Play Additional Terms

If you download the App from Apple App Store or Google Play Store, the following additional terms apply:

13.1 Apple App Store

• These Terms are between you and EzyTrip LLC only, not Apple Inc. Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any product liability claims or any failure to conform to applicable legal or regulatory requirements.
• You represent that you are not located in a country subject to a U.S. Government embargo.

13.2 Google Play

• These Terms are between you and EzyTrip LLC only, not Google LLC.
• Google has no obligation to provide support, refunds, or warranty for the App.

14. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and EzyTrip LLC regarding the Services.
• Severability: If any provision of these Terms is found invalid, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to enforce any right or provision shall not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. EzyTrip LLC may assign its rights without restriction.
• Force Majeure: EzyTrip LLC is not liable for failures due to causes beyond its reasonable control.
